This Privacy Policy explains how Pal Consultancy Services ("we", "our", "us"), operating the FOMO platform at payfomo.in, collects, uses, stores, and protects your personal information when you use our services. By using FOMO, you agree to the practices described in this policy.

FOMO is a technology platform. We do not store your payment credentials or hold your money. All payment processing is handled by our licensed Payment Gateway partners.

1. Information We Collect

1.1 Information You Provide

  • Full name and mobile number during registration
  • Email address (optional, for account recovery and notifications)
  • Date of birth (for age verification and birthday rewards)
  • Profile preferences such as favourite venue categories and city
  • Influencer creator profile details if you join the Creator Program
  • Business information if you register as a merchant partner

1.2 Information Collected Automatically

  • Device information including device type, operating system, and unique device identifiers
  • App usage data including screens visited, features used, and session duration
  • Location data (only when you grant permission) to show nearby partner venues
  • Transaction metadata including venue name, transaction amount, timestamp, and discount applied — note: we do not receive or store your bank account or UPI credentials
  • Log data including IP address, app version, crash reports, and performance data

1.3 Information from Third Parties

  • Payment confirmation data from our Payment Gateway partners (transaction ID, status, amount)
  • Social login data if you choose to sign in via Google or other providers
  • Influencer referral attribution data when you use a creator promo code

2. How We Use Your Information

  • To create and manage your FOMO account
  • To process your payments and apply discounts at partner venues
  • To track and credit FOMO points to your account
  • To send transactional notifications about your payments and bookings
  • To provide personalised venue recommendations based on your preferences and history
  • To calculate and pay influencer creator commissions accurately
  • To detect and prevent fraud, abuse, and unauthorised account access
  • To comply with applicable laws including the Information Technology Act 2000 and the Digital Personal Data Protection Act 2023
  • To improve our platform through anonymised usage analytics
  • To send you promotional communications about new venues, offers, and features (you may opt out at any time)

3. How We Share Your Information

We do not sell your personal data to any third party. We share your information only in the following circumstances:

3.1 Payment Gateway Partners

We share your transaction details with our licensed Payment Gateway partners (such as Paytm, Cashfree, or Razorpay) solely to process your payments. These partners are bound by their own RBI-compliant privacy policies and do not receive more information than is necessary to complete your transaction.

3.2 Partner Venues

When you make a booking or payment at a partner venue through FOMO, that venue receives confirmation of your booking and the discounted amount. They do not receive your bank details, UPI ID, or full mobile number.

3.3 Legal Requirements

We may disclose your information to law enforcement or regulatory authorities when required by law, court order, or to protect the rights and safety of our users and the public.

3.4 Business Transfers

In the event of a merger, acquisition, or sale of assets, your data may be transferred to the acquiring entity, subject to the same privacy protections described in this policy.

4. Data Retention

  • Account data is retained for the duration of your account and for 3 years after deletion as required by Indian law
  • Transaction records are retained for 8 years to comply with GST and financial record-keeping requirements
  • Marketing preferences and opt-outs are retained indefinitely to honour your choices
  • Anonymised analytics data may be retained indefinitely as it cannot identify you

5. Your Rights Under DPDP Act 2023

Under the Digital Personal Data Protection Act 2023, you have the following rights:

  • Right to access the personal data we hold about you
  • Right to correction of inaccurate or incomplete personal data
  • Right to erasure of your personal data, subject to legal retention requirements
  • Right to grievance redressal through our Grievance Officer
  • Right to nominate a person to exercise your rights in case of death or incapacity

To exercise any of these rights, contact our Grievance Officer at grievance@payfomo.in. We will respond within 30 days.

6. Data Security

  • All data transmitted between your device and our servers is encrypted using TLS 1.2 or higher
  • We do not store your UPI ID, bank account number, or payment credentials on our servers
  • Access to personal data within our organisation is restricted to personnel who need it to perform their duties
  • We conduct periodic security assessments of our platform and infrastructure

Despite these measures, no digital system is completely secure. If you believe your account has been compromised, contact us immediately at legal@payfomo.in.

7. Cookies and Tracking

Our mobile application does not use browser cookies. We use local device storage to maintain your session and preferences. We use anonymised analytics SDKs to understand app usage patterns. You may reset your advertising ID through your device settings to limit interest-based tracking.

8. Children's Privacy

FOMO is not intended for users under the age of 18. We do not knowingly collect personal data from minors. If you believe we have inadvertently collected data from a minor, please contact us at legal@payfomo.in and we will delete it promptly.

9. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you through the app and update the "Last Updated" date above. Your continued use of FOMO after the changes take effect constitutes your acceptance of the updated policy.

In accordance with the Information Technology Act 2000 and the Digital Personal Data Protection Act 2023, we have appointed a Grievance Officer:
